Racial Equity - It’s a Matter of Life or Death, Legislative Updates, Re-opening Update, Grants

Dear NPW Community:

NPW knows the past weeks have been very difficult for our county, state, nation and communities of color - particularly our African American and Black neighbors and communities. We also know that the disturbing incidents of the past few weeks are not new. That is why, even before all the recent public attention to racial violence and systemic racism, NPW planned important educational initiatives on this subject that utilize the knowledge and resources of our diverse member agencies.

We remain hopeful that as we move forward, all sectors of our society will pay attention to systemic racism and that together racism will be combatted and racial equity will move forward.

LEGISLATIVE UPDATES

Federal Updates

Paycheck Protection Flexibility Act Passage:

The U.S. Senate passed H.R. 7010, the Paycheck Protection Flexibility Act, by unanimous consent. As a refresh, the bill passed the House on May 28th and, if signed by the President will: 

  • Extend the PPP through 12/31/2020
  • Extend the rehire deadline until 12/31/2020
  • Expand the covered period for loan use from eight weeks to 24 weeks
  • Expand maturity from 2 years to 5 years for new loans and permit borrower and lender to mutually agree to later maturity

Forgiveness Provisions include:

  • Eases rehire requirement based on inability to rehire former or similarly qualified employees, or inability to return to operations levels
  • Revises the 75%/25% rule to 60%/40%
  • Defers payments of principal, interest, and fees until either the date the lender receives payment for the forgiven amount of loan or 10 months after the end of the covered period
  • Makes PPP participants eligible for employer payroll tax deferral (CARES Act Sec. 2302) 

Unemployment insurance legislation 

A new bill (H.R. 7066) introduced June 1st by Representative Brady, would partially fix the unemployment payments challenge for reimbursing (self-insured) nonprofits. The bill includes the text from the House-passed HEROES Act (Sec. 50005) that clarifies that nonprofits and other reimbursing employers do not have to pay 100 percent of their unemployment bill upfront and wait for repayment from the state. The Brady bill would correct the language in the CARES Act that led the U.S. Department of Labor to insist that full payments must be made immediately. The bill would also allow workers to keep two weeks of the supplemental federal UI benefits ($1,200) after accepting a job, available from a week after the date of enactment until July 31, 2020. 



State Updates 

State legislature will be in session next week  

Senate Majority Leader Stewart-Cousins and Assembly Speaker Heastie announced they are working on bills related to recent protests and unrest and will continue their session next week. 

Comptroller DiNapoli nonprofit contracting report 

New York State Comptroller DiNapoli’s 2019 Calendar Year Not-For-Profit Prompt Contracting Annual Report released this week found the percentage of late contracts increased from 47% in 2018 to 50% in 2019. Almost half of the agencies reported at least three quarters of their contracts were not processed on time.

New York State Comptroller DiNapoli created a video in support of nonprofits in New York, highlighting that nonprofits account for one out of eight jobs in every region in our state, and the Comptroller's COVID-19 Financial Survival Toolkit for New Yorkers resources for nonprofits section.



RE-OPENING UPDATE

County Executive Latimer Announces Reopening Task Force

Westchester County Executive George Latimer announced the formation of the Westchester County Reopening Task Force – a group charged with working to find solutions to advance the interests of local businesses in a post-coronavirus economy. This task force will provide guidance to the County as it works through the four phases of reopening and help ensure that businesses in each phase have what they need to reopen safely and successfully. Outdoor Dining to be Permitted

Governor Andrew M. Cuomo announced that outdoor dining at restaurants will be permitted in Phase Two of reopening. Outdoor tables must be spaced six feet apart, all staff must wear face coverings and customers must also wear face coverings when not seated. As a reminder, Westchester County is currently in Phase One of reopening and, if all goes well, we expect to be in Phase Two by June 9th. To read the New York State Liquor Authority Guidance on Outdoor Expansion of Licensed Premises click here.

Low-Risk Outdoor Recreational Activities to Resume

On Tuesday, June 2, 2020 the Governor issued an Executive Order allowing low-risk, outdoor recreational activities and businesses providing such activities to open in regions that have met the public health and safety metrics required for Phase One. These activities include tennis, non-motorized boat use and rentals (such as kayaks and rowboats), and golf and driving ranges. More details about this will be forthcoming from the state. 

NYS Releases Detailed Guidance for Businesses Reopening in Phase Two

New York State has released detailed Guidance for businesses allowed to reopen in Phase Two. These businesses include:

  • Offices
  • Real Estate
  • Essential and Phase II In-Store Retail
  • Vehicle Sales, Leases, and Rentals
  • Retail Rental, Repair, and Cleaning
  • Commercial Building Management
  • Hair Salons and Barbershops

Reminder, Westchester County is currently in Phase One of reopening. NYS Guidance for phase one reopening is available here.

FUNDING

NYS $100 million New York Forward Loan Fund

The New York Forward Loan Fund (NYFLF) is a new economic recovery loan program aimed at supporting New York State small businesses, nonprofits and small landlords as they reopen after the COVID-19 outbreak and NYS on PAUSE. The NYFLF targets the state’s small businesses with 20 or fewer full-time equivalent (FTE) employees (90% of all businesses), nonprofits and small landlords that have seen a loss of rental income. The NYFLF is specifically timed to support businesses and organizations as they proceed to reopen and have upfront expenses to comply with guidelines (e.g., inventory, marketing, refitting for new social distancing guidelines) under the New York Forward Plan. To fill out a pre-application and match with a participating lender, please click here.

IMLS CARES Act Grants for Museums and Libraries

These grants will support the role of museums and libraries in responding to the coronavirus pandemic. As part of the nation’s response to the pandemic through the CARES Act, IMLS is funding direct grants to respond quickly, efficiently, and with significant impact to the national emergency. They welcome projects that will create opportunities for museums and libraries to support positive socio-economic change now and in a future reopened environment. This can be through preserving jobs, staff training and development, addressing the digital divide, planning for reopening, and providing technical support and capacity building for digital inclusion and engagement, prioritizing our highest-need communities. Awards of $25,000 - $500,000 will be made for two year periods. The grant is due June 12, 2020. Click here for more information.
