Background

The State has long contracted with nonprofits to provide essential services to communities across New York. But persistent delays in payment, an over-reliance on nonprofits to front costs, a burdensome contracting process, and other serious inefficiencies have undermined the sector’s stability for decades and weakened the system of care for those in need. Here is a snapshot:

• One in three nonprofits that have New York State contracts are owed funding for services already provided
• $650 MILLION is owed by the State to nonprofits
• 65% of organizations expressed concern about funding basic operations in 2025.

Solution

If signed into law by Governor Hochul, S7001 Mayer/A7616 Paulin - unanimously passed in the NY State Senate and Assembly - greatly needed changes to the Prompt Contracting Law will be actualized:

• Clarify the law and create consistency in contracting across all agencies
• Expand and clarify renewal contracts
• Mandate advance payments and de minimis administration in all contracts

Why This Makes Sense for Nonprofits, Corporate and Foundation Sponsors, Donors, and For-profits. Persistent delays in both contracting and payment are an inefficient use of taxpayer dollars.

• We ALL rely on the nonprofit sector to deliver services to our employees, family members, friends, and neighbors. We all deserve a contracting system that is fair, prompt, and efficient.
  
  
• Nonprofits should not have to take out loans or use philanthropic dollars to essentially float loans to New York State.
