Update on Lawsuit Filed by the National Council of Nonprofits - Judge Grants NCN's Motion for a Preliminary Injuction 

On February 25th, 2025, judge grants NCN's motion for a preliminary injunction to prevent unilateral federal funding freeze by the White House Office of Management and Budget.

Executive Orders Update  - Judge Blocks DEI Orders 

On Friday, February 21st, 2025, a federal judge issued a preliminary injunction blocking two executive orders (EO 14151, and EO 14173) attempting to terminate or change federal grants and contracts for programs related to diversity, equity, and inclusion. The judge ruled that the policies and term “diversity, equity, and inclusion” as used in the EOs were potentially vague, discriminating, and unconstitutional by penalizing private organizations, including charitable nonprofits. Joint Office of the Governor and the Office of the NYS Attorney General Guidance to Private and Non-Profit Organizations and Entities

This guidance document is intended to provide information to private and nonprofit entities like social services agencies and providers (including homeless shelters, domestic violence shelters, and other residential facilities as well as non- residential and drop-in sites for social services); houses of worship such as churches, synagogues, mosques, and temples; medical and healthcare facilities; and other entities that provide community services and spaces, in evaluating how to respond to requests from federal immigration authorities while protecting the rights of their residents, clients, patients, members, and staff.

A coalition of organizations filed a Motion for Temporary Restraining Order in the U.S. District Court for the District of Columbia to block the White House Office of Management and Budget from pausing all agency grants and loans, as revealed in a memo issued January 27, 2025.

Pause of Federal Grant, Loan and Other Federal Assistance Programs Effective on January 28, 2025 at 5 PM

In a two-page MEMO, the Office of Management and Budget (OMB) ordered all federal agencies to stop the issuance of new grants and disbursement of Federal funds under all open awards. This memo requires Federal agencies to identify and review all Federal financial assistance programs and supporting activities consistent with the President’s policies and requirements. 

OMB also released instructions for federal financial assistance program analysis in support of Memo 25-13 and two-page guidance memo that narrows the scope of the funding freeze, with explicit mention of Medicaid and SNAP joining Medicare and Social Security as exempt programs.

Guidance Concerning Local Authorities’ Participation in Immigration Enforcement and Model Provisions by the Office of NYS Attorney General
